Conversion Law No. 74\/2025<\/a>\u00a0of\u00a0\u00a0Decree Law No. 36\/2025<\/a>\u00a0amended Article 17, Paragraph 1, of\u00a0Law No. 91\/1992<\/a>, allowing former citizens residing abroad, in specific cases and for a limited period of time, to reacquire Italian citizenship by\u00a0personally signing a declaration before the competent consular officials<\/strong>.<\/p>\n

EFFECTS OF REACQUISITION<\/strong><\/p>\n

The declaration of reacquisition\u00a0has no retroactive effect<\/strong>: the former citizen reacquires Italian citizenship from the NEXT day after signing the declaration.<\/p>\n

TRANSMISSION OF CITIZENSHIP TO DESCENDENTS<\/strong><\/p>\n

With the entry into force of the new legislation, the reacquisition of citizenship\u00a0DOES NOT<\/strong>\u00a0allow the automatic acquisition of citizenship by children, even in case they are minors (obviously this applies to adults as well) and living with the parents, if they reside abroad.<\/p>\n

LIMITED TEMPORAL WINDOW FOR REACQUISITION<\/strong><\/p>\n

The declaration of reacquisition by the former citizen must be submitted, together with the necessary documentation,\u00a0between July 1, 2025 and December 31, 2027<\/strong>.<\/p>\n

ELIGIBILITY<\/strong><\/p>\n

To be entitled, the following requirements must be met:<\/p>\n

    \n
  1. the person\u00a0must have been born in Italy\u00a0<\/strong>OR,\u00a0if born outside Italy, must have been resident in Italy for at least two continuous years<\/strong>;<\/li>\n
  2. the person lost his\/her citizenship\u00a0before August 16, 1992<\/strong>.<\/li>\n<\/ol>\n

    DOCUMENTATION REQUIRED FOR REACQUISITION<\/strong><\/p>\n

    BEWARE<\/strong>: The Consulate does NOT return submitted documentation.<\/p>\n

      \n
    1. Application for reacquisition<\/strong>\u00a0(Click on the link<\/a>), duly filled.<\/li>\n
    2. Canadian passport and proof of residence<\/strong>\u00a0in this consular jurisdiction (driver\u2019s license or utility bill)<\/li>\n
    3. If available, Italian ID even if expired.<\/li>\n
    4. Consular fee of Euro 250<\/strong>\u00a0for the declaration of reacquisition\u00a0to be paid on the day of the appointment in Canadian dollars<\/strong>\u00a0in cash or through money order\/bank draft entitled to the Consulate General of Italy in Montreal.     5. If born in Italy<\/strong>: Extract of birth certificate (NOT a simple birth certificate) issued recently by the Italian municipality of birth.<\/li>\n
    6. If born abroad<\/strong>:<\/li>\n<\/ol>\n

      6a)\u00a0foreign act of birth<\/strong>\u00a0with apostille and Italian translation<\/p>\n

      6b)\u00a0historical certificate of residence<\/strong>\u00a0issued by the last Italian municipality of residence.<\/p>\n

        \n
      1. in any case<\/strong>: Historical certificate of citizenship issued by the Italian municipality of birth or of last residence.<\/li>\n
      2. in any case<\/strong>: the original Canadian citizenship certificate (long form) is required: it must include these essential details:<\/li>\n<\/ol>\n
