Divorce

PLEASE NOTE

Foreign divorce sentences must be registered in Italy. The recognition is carried out by the Registrar of the Italian Municipality if the sentence has become final (therefore if it is actually valid in Canada), if it is not pending in Italy for the same reason, if between the same spouses no similar procedure had been started before the foreign one.

The recognition takes place in application of art. from 64 to 71 of the Law of 31 May 1995, n. 215.

Procedure to follow and necessary documents:

1. Application for recognition of the divorce duly completed

2. Request a certified copy of the following documents from the Court that issued the sentence:
a) Judgment of Divorce
b) Certificate of Divorce

3. Obtain the apostille by the competent Canadian Authorities. For documents issued in Quebec, please refer to the website of the Ministry of Justice of Quebec. For information regarding apostilles on documents issued by the provinces of New Brunswick, Prince Edward Island, Nova Scotia, Newfoundland and Labrador and Nuvavut, please refer to Global Affairs Canada.

4. Have them (except the apostille) translated into Italian by one of the official translators of this Consulate General.

Once this step is completed, all the aforementioned documents will be sent by mail to our Consulate General, accompanied by a copy of the applicant’s proof of ID and a “money order” of the value of two payments corresponding to art. 69 of the table of consular fees for the translations of the Divorce Judgment and the Divorce Certificate.
