Specifically, the new legislation indicates that, in the event of a concrete and present danger that, due to the move abroad, he or she may avoid the fulfillment of his or her obligations to the children, it will be possible for the other parent to apply for an injunction against the issuance of the documents.

The injunction may be filed with the competent judge at the ordinary court where the child has his or her habitual residence or, if the child is resident abroad, the court of competence for their residence.
